Terms and Conditions
- COMPETITION DURATION.
The competition runs from the date specified whenthe guest judge is announced, until the day the shortlist is announced, approximately eleven weeks later. The judge then has two weeks to choose and announce the competition winner. The competition runs every 3 months, with a different judge each time.
- COMPETITON ORGANISERS.
For the purposes of the competition, the organisers are Carbon Logic - address Flat D, 38 Denmark Villas, Hove BN3 3TE.
- ELIGIBILITY.
The competition is open to all legal residents of the UK aged 16years or over. The competiton is void where it is prohibited or restricted by law. This competition is subject to the laws of England, applicable statutory rights not affected. The partners in Carbon Logic and their immediate family members are not eligible to enter into the competiton.
- HOW TO ENTER.
An entrant (as hereinafter defined) may enter the competiton at any time during the competiton period by uploading one or more tracks onto Carbon Logic, and by expressly consenting to the official rules of this competiton. By agreeing to the terms and conditions, you acknowledge and accept the official rules and agree to be bound by them. Carbon Logic does not accept responsibility for any late entries. Tracks uploaded after the competiton deadline has ended will be eligible for the next competiton.
- PRIZE.
The prize is two consecutive days' recording time in a professional recording studio.
- The winner of the competition will be informed by email, and phone if possible, within a week of the judge's decision.
- he session will take place on 2 consecutive days within a month of the winner being announced.
- Carbon Logic will choose the recording studio that the winning session takes place at, which may be different each time the competition is held.
- Carbon Logic will organise and pay for accomodation for one night, for up to 4 band members. Additional band members will finance their own accomodation. The offer of accomodation is only available to band members who do not live in the same city as the recording studio chosen for the winning session.
- Recording sessions will be 10 hours long, including an hour's break for lunch.
- The winner will receive a CD of the recordings, and AIFF/WAV audio files as data if they want to use the material in another studio.
- The winning act retains all copyright in the recordings made.
- Carbon Logic will retain copies of the recordings, as backups, for 2 months.
- A simple agreement will be signed to assure the winner that Carbon Logic will not use any of the recorded material without their express permission.
- Carbon Logic will request the right to upload the winner's recordings to the Carbon Logic website as part of an editorial feature.
- If the winner fails to respond to the offer within one week of being alerted by Carbon Logic, or is unable to attend the recording session within the one month period offered, Carbon Logic retains the right to award the prize to another shortlist entrant.
- The odds of winning are diificult to predict, and will depend on the popularity of any track (number of times played, and overall score rating), the opinions of the Guest Judge presiding over the particular competition, and the Carbon Logic administrators.
- AWARDING OF THE PRIZE.
The winning track will be chosen by a judge from a short list of 10 tracks, that will be published to the site. The shortlist is chosen by the administrators of Carbon Logic, who reserve the right to choose any track uploaded to Carbon Logic. The shortlsit is not a direct representation of overall popularity of tracks. Nevertheless the administrators will be aware of track statistics, including how often they are played and their overall score ratings, and this will be taken into account when the shortlist is chosen.
- GENERAL TERMS AND CONDITIONS.
- 7.1 Verification of entries.
The validity of any entry is subject to verification by Carbon Logic. Any illegal entry will be rejected. Any track uploaded where the copyright in the track has been infringed will be rejected. All decisions of Carbon Logic with respect to any aspect of the competition, including eligibility and disqualification of entrants, are final, without right of appeal.
- 7.2 Acceptance of Prize.
The prize, save as provided for in these rules, must be accepted as described above and cannot be substituted for another item or exchanged in whole or in part for money.
- 7.3 Substitution of Prize.
In the event that, for reasons beyond Carbon Logic's control and not related to the winning entrant, Carbon Logic is unable to award the prize as described in these rules, Carbon Logic reserves the right to award a prize of the same nature and an equivalent value.
- 7.4 Number of Winners.
In the event the number of winners chosen is greater than the number of prizes available for any reason beyond the control of Carbon Logic, such as an error or mechanical, electronic or other defect that occurs in the management, design or implementation of the competition, Carbon Logic reserves the right to end the competition in whole or in part, without notice, at any time.
- 7.5 EXCLUSION OF LIABILITY-General.
By participating in this competition, each entrant agrees to release and hold Carbon Logic, as well as their advertising and promotions agencies, partners, affiliates, directors, agents and employees, harmless from any and all liability whatsoever for any injuries, losses or damages of any kind arising from participation in or in connection with the competition, including, without limitation:
i) Awarding, acceptance, receipt, possession, use and/or misuse of the prize awarded herein.
And/or
ii) Participation in any prize related activities, such as travelling to or from any prize related activity.
- 7.6 EXCLUSION OF LIABILITY-Competition Operation.
By entering the competition, each entrant releases and discharges Carbon Logic as well as their advertising and promotions agencies, partners, affiliates, directors, agents and employees, harmless from any and all liability resulting from any malfunction of any computer component, software or communication line, any loss or absence of network communication, any faulty, incomplete or unintelligible transmissions, or any transmissions that are erased by a computer or network which could limit the opportunity of any individual to enter the competiton, or prevent them from doing so.
- 7.7 MODIFICATION.
Carbon Logic reserves the right to modify, cancel, terminate or suspend the competition in whole or in part, at its sole discretion in the event of a virus, a computer bug or unauthorised human intervention or any other cause that is beyond the control of Carbon Logic that could corrupt or affect the administration, security, impartiality or normal course of the competition.
- 7.8 PERSONAL INFORMATION.
By completing and submitting your personal information, you consent to:
i) The collection, use and disclosure of your personal information by Carbon Logic for the purposes of Carbon Logic's internal use, to facilitate your participation in the competition, and selecting and contacting the competiton winner.
ii) The use of your personal information for providing you with information on Carbon Logic products and services, if you have so elected.
- 7.9 THIRD PARTY INFORMATION.
Your use of Third Party software, hardware, products and/or services (collectively the "Third Party Information") shall be governed by and subject to your agreement with the Third Party, including without limitation, your agreement to the terms and conditions of separate Third Party information licences, if any. Any Third Party information that is provided with or without Carbon Logic's products and/or services is provided "as is".
Carbon Logic makes no representation, warranty or guarantee whatsoever in relation to the Third Party information even if Carbon Logic has been advised of the possibility of such damages or can anticipate such damages. The inclusion of Third Party information herein does not imply endorsement by Carbon Logic of the Third Party information or the Third Party in any way. Carbon Logic does not control and is not responsible for any Third Part information including without limitation, the content, compatability, accuracy, intellectual property issues, performance, trustworthiness, legality, decency, links, or any other aspect of the Third Party information.
